Terms and Conditions

The Underground Sydney provides a safe and enjoyable environment for all customers and staff. These general terms and conditions apply to all visitors, customers, booking agents, and staff attending the venue and are subject to change without notice, based on the specific needs at the sole discretion of The Underground.

Intellectual property

The Site and its original content, features and functionality are owned by The Underground and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.

Links to other sites

Our Site may contain links to third-party sites that are not owned or controlled by The Underground.

The Underground has no control over and assumes no responsibility for, the content, privacy policies, or practices of any third-party sites or services. We strongly advise you to read the terms and conditions and privacy policy of any third-party site that you visit.

Governing law

This Agreement (and any further rules, policies, or guidelines incorporated by reference) shall be governed and construed by the laws of NSW, Australia, without giving effect to any principles of conflicts of law.

General event conditions

  • The Underground reserves the right to inspect/search the bags of all persons who enter or exit the venue, regardless of size. This may include touching the outside of the bag and/or seeking assistance from the bag owner to remove items from the bag.
  • Patrons who cause a disturbance or refuse to comply with requests made by The Underground staff or contracted security will be evicted from The Underground.
  • Pass-outs may not be issued. In the instance that pass-outs are issued, patrons will be forced to re-queue and re-entry is not guaranteed.
  • Alcoholic beverages cannot be taken into or from The Underground by patrons.
  • Customers wishing to bring personal items into The Underground do so at their own risk. The Underground will not be held responsible for any damages to, loss or theft of a patron’s personal property.
  • In accordance with the Smoke-Free Environment Act 2000 No.69, The Underground is a smoke-free building. Smoking or vaping is not permitted anywhere inside the Venue. Any patron who refuses to comply will be removed from the venue. There is a dedicated outdoor area for patrons who wish to smoke or vape.
  • All patrons purchasing tickets or attending events within the Venue are asked to assess their own risk before entry.
  • For events, patrons are not permitted to bring personal or commercial food or beverage products into the venue. Decisions about whether such products will be permitted are at the discretion of The Underground or based on specific event requirements. Patrons will generally be advised to dispose of such items or will have the items confiscated before entering the Venue.
  • The Underground may utilise audio and visual recording equipment to record the event. The image or likeness of visitors, patrons, delegates and staff may be captured, and these images and recordings may be utilised by The Underground for marketing and promotional materials in the future.
  • The Underground is monitored by a CCTV network, persons entering the Venue acknowledge this.

Restricted/prohibited items

The following items are not permitted into The Underground for exclusive events:

  • Drinks of any kind, including bottled water. You will be asked to empty the contents of your bottle upon entry.
  • Glass (containers, bottles, glasses)
  • Drugs
  • Weapons of any kind e.g. knives, guns
  • Aerosol spray containers of any description
  • Animals (Guide dogs excluded)
  • Items considered illegal or dangerous

Liquor licensing

All patrons entering The Underground are advised that:

  • They are entering a licensed premise.
  • Intoxicated persons will not be permitted to enter.
  • Persons in possession of liquor will not be permitted to enter.
  • Checking procedures will apply to prevent persons possessing liquor from entering.
  • Intoxicated persons will be removed from the premises.
  • It is an offence for minors to purchase and consume liquor.
  • It is an offence to purchase liquor for (or supply liquor to) minors.
  • Persons supplying liquor to minors will be reported to the Police and penalties apply under the Liquor Act 2007.
  • Valid proof of identification is required for access to 18+ events.
  • The Underground supports the responsible service of alcohol.

Refusal of entry

For the comfort, safety and enjoyment of all patrons, The Underground staff reserve the right to:

  • Refuse entry to any persons deemed to be intoxicated and/or disorderly.
  • Refuse entry to any unauthorised persons.
  • As a minimum for general admission, patrons must be appropriately clothed for a public place and must wear shoes. Patrons with bare feet will not be permitted entry.

Changes to this agreement

We reserve the right, at our sole discretion, to modify or replace these Terms of Service by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms of Service.

Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.
